Breathey is a free breathing app. By using it you agree to a few common-sense rules. The bullet points below are the gist; the rest of this page just unpacks them.
- Breathey is a wellness tool, not a medical device. Don’t use it instead of a doctor.
- You get a personal, free license to use the App. Don’t resell it or break it apart.
- Your data is yours. Delete it anytime from inside the App.
- The App is provided “as is”, and our liability is limited to what the law allows.
- We’re a small team based in New Zealand. If something’s off, write to us.

What this covers
These terms apply to:
- The Breathey iOS app (the “App”).
- The breathey.app website, including the newsletter and support form (the “Site”).
When we say “you” we mean the person using the App or the Site. By installing, opening or continuing to use Breathey, you agree to these terms. If you don’t agree, please don’t use it.
These terms work alongside our Privacy Policy, which explains how we handle your data.
Who can use Breathey
Breathey isn’t directed at children. You must be at least 13 years old to use the App (or 16if you’re in the European Union, or the minimum digital-consent age in your country if higher). If you’re under the legal age of majority where you live, please use Breathey only with the involvement of a parent or guardian.
Health disclaimer — please read
Breathey is a wellness and relaxation tool. It is not a medical device, and it doesn’t diagnose, treat, cure or prevent any condition. The breathing patterns, reminders, and any text in the App are not medical advice and are not a substitute for talking to a qualified healthcare professional.
Breathing exercises can affect your body in real ways. They might cause light-headedness, tingling, or changes in heart rate. Please be careful — and talk to a doctor first — if any of the following apply to you:
- You’re pregnant.
- You have a heart condition, low or high blood pressure.
- You have a respiratory condition (asthma, COPD, etc.).
- You have a history of seizures, panic attacks, or significant anxiety.
- You’re recovering from surgery or any medical procedure.
Never use Breathey while driving, cycling, operating machinery, swimming, or doing anything that needs your full attention.If you feel unwell during a session, stop, breathe normally, and seek help if it doesn’t pass.
Health-data sync (HealthKit / Health Connect) writes “Mindfulness minutes” for completed sessions if you turn it on. Those numbers are for your own reference — they’re not a clinical record.
You use Breathey at your own discretion and at your own risk.
Your license to use Breathey
The App is free. We grant you a personal, non-exclusive, non-transferable, revocable license to install and use Breathey on devices you own or control, for your own non-commercial use, subject to these terms and to the rules of the platform you got it from (e.g. the Apple App Store).
We keep all rights we don’t explicitly grant. In particular, you may not:
- Sell, rent, sublicense, or redistribute the App.
- Reverse-engineer, decompile or disassemble it, except where the law specifically allows.
- Remove or hide any copyright, trademark or attribution notices.
- Use the App or its content to train machine-learning models without our written permission.
“Breathey”, the Breathey logo and the visual identity of the App and Site are ours. You can’t use them as your own branding.
Acceptable use
When you use Breathey, please don’t:
- Try to break, overload, or interfere with the App, the Site, or our backend (Firebase / Firestore).
- Probe, scan or test the security of our systems, or bypass authentication, rate limits, or App Check protections.
- Submit content through the support form or newsletter that’s unlawful, abusive, or impersonates someone else.
- Use the App in a way that violates any law that applies to you.
- Use automated tools to scrape or harvest the Site, beyond standard search-engine indexing.
If you abuse the service, we may block your access (see Termination below).
Account & your data
Breathey creates an anonymous Firebase accounton first launch. You don’t need to give us your email or name to use the App. If you want to back up your sessions across devices, you can optionally use Sign in with Apple, which is handled by Apple.
You’re responsible for keeping the device you use Breathey on reasonably secure.
Your breathing sessions, settings and reminders belong to you. We don’t claim any ownership over them. You can delete everything at any time from Settings → Privacy → Delete All Data, which wipes local data, your cloud backup and your Firebase account in one go.

Third-party services
Breathey relies on a few third-party services to work. When you use a feature that depends on one of them, that provider’s own terms also apply:
- Apple — App Store distribution, Sign in with Apple, HealthKit, Live Activity, App Tracking Transparency.
- Google / Firebase — anonymous auth, Firestore (cloud backup), Analytics, Crashlytics, App Check.
- Google (Android) — Health Connect, when you use the Android version.
- Brevo — newsletter list and the support email pipeline on the Site.
We’re not responsible for outages or behavior of third-party services we don’t control. If one of them goes down, parts of Breathey may stop working until it’s back.
Availability and changes
Breathey is offered for free with no service-level commitments. We’ll do our best to keep it running, but we don’t guarantee uptime, and the App and Site may be unavailable for maintenance, platform issues, or reasons outside our control.
We may add, change, or remove features at any time. If a change materially reduces what Breathey does for you, we’ll try to give you reasonable notice in-app or by email (if you’re on the newsletter).
Termination
You can stop using Breathey any time — uninstall the App, and use Settings → Privacy → Delete All Data first if you want a clean slate.
We may suspend or terminate your access if you violate these terms, abuse the service, or put other users or our infrastructure at risk. When we can, we’ll tell you why.
Sections that by their nature should survive termination — health disclaimer, intellectual property, disclaimers, limitation of liability, governing law — survive.
Disclaimers
Breathey is provided “as is” and “as available”, without warranties of any kind, either express or implied, to the maximum extent allowed by law. That includes (without limitation) implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We don’t warrant that the App will be uninterrupted, error-free, secure against every attack, or that it will produce a particular wellness or health outcome.
Some jurisdictions don’t allow exclusions of certain warranties (for example consumer-protection laws in New Zealand, the EU, the UK and Australia). Nothing in these terms limits rights you have under those laws — those rights stand.
Limitation of liability
To the maximum extent allowed by law, Amaze Labs and the people who work on Breathey are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits, revenue, goodwill, or substitute services, arising from or related to your use of (or inability to use) Breathey.
For any direct damages, our total liability to you for all claims related to Breathey is limited to NZD 100, or the amount you paid us in the 12 months before the event giving rise to the claim — whichever is greater. Since Breathey is free, that amount is usually NZD 100.
Nothing in these terms limits liability that can’t legally be limited (for example, liability for fraud or for death or personal injury caused by negligence).
Apple App Store terms
If you got Breathey from the Apple App Store, the following also applies, and prevails over anything inconsistent in these terms:
- These terms are between you and Amaze Labs only — notwith Apple. Apple isn’t responsible for the App or its content.
- The license we grant you is limited to using Breathey on Apple-branded devices you own or control, as permitted by the App Store Terms of Service.
- Apple has no obligation to provide maintenance or support for Breathey. If you have a support request, write to us at /support.
- Apple isn’t responsible for any product warranties, whether express or implied. If the App fails to conform to any warranty, you may notify Apple and Apple will refund the purchase price (if any) — Apple has no further warranty obligation.
- Amaze Labs (not Apple) is responsible for handling claims relating to the App, including product liability, legal compliance, and intellectual-property claims.
- You represent that you’re not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you’re not on any U.S. list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Governing law
These terms are governed by the laws of New Zealand. Disputes that can’t be resolved by writing to us first will be handled by the courts of New Zealand.
If you’re a consumer in the EU, UK, Australia or another country with mandatory consumer-law protections, you keep the right to bring a claim under the law of the country you live in.
Changes to these terms
We may update these terms from time to time. If a change is significant, we’ll update the “effective date” below and, if it materially affects you, mention it in-app or by email to newsletter subscribers. Older versions are available on request.
If you keep using Breathey after a change takes effect, you accept the updated terms. If you don’t, you can stop using the App and delete your data.
